If you are already behind on payments, your credit has likely been impacted. Settled accounts are typically reported as "settled for less than full balance" or similar language, which is generally negative but often better than continued late payments or charge-offs. For many clients, stopping the spiral of missed payments and collection activity is the more important goal.
Debt settlement is generally appropriate for unsecured consumer debts such as credit cards, medical bills, personal loans, and certain deficiency balances. It is usually not used for most taxes, child support, alimony, or student loans. Part of your consultation will include identifying which debts may be candidates for negotiation.
In many cases, the portion of debt forgiven through settlement can be treated as taxable income.
